1. Acceptance of these terms

By accessing or using ecomvue.ai (the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and Jan Derdelinckx (trading as EcomVue), a sole trader established under Belgian law ("EcomVue", "we", "us").

2. What EcomVue does

EcomVue is an online tool that generates an AI-powered audit report ("Report") analysing the AI search visibility of a given e-commerce store URL you provide. The Report consists of up to seven sections covering how the store may appear in AI-generated search results and recommendations. EcomVue also offers optional recurring monitoring plans ("Subscription Plans" — Monitor, Pro, Agency) that generate Reports on an ongoing, automated cadence and unlock additional features such as competitor tracking, alerts, and scheduled re-audits.

What EcomVue is not:

  • EcomVue is not a professional consultancy service.
  • EcomVue does not provide legal, financial, or marketing advice.
  • EcomVue does not guarantee any improvement in your store's visibility or revenue.
  • EcomVue is not affiliated with Anthropic, Google, OpenAI, or any AI platform referenced in Reports.

3. AI-generated content disclaimer

Reports are generated automatically using a third-party large language model (currently Anthropic Claude) combined with web search. By their nature, AI-generated outputs:

  • !May contain errors, inaccuracies, or outdated information. AI systems can hallucinate facts, misinterpret data, or reflect information that has changed since the model's training cutoff.
  • !Are informational only. Nothing in a Report constitutes professional advice of any kind. You should not make significant business decisions based solely on a Report without independent verification.
  • !Reflect a point-in-time snapshot. Search engine and AI platform behaviour changes frequently. A Report is valid only as a snapshot at the time of generation.
  • !Are not a guarantee of results. EcomVue makes no representation that implementing suggestions from a Report will improve your search visibility, revenue, or any other business metric.

You accept full responsibility for how you use or act on the contents of a Report.

4. Eligibility and account

You must be at least 18 years old and have legal capacity to enter into contracts. If you are acting on behalf of a business, you warrant that you have authority to bind that business to these Terms. A one-time Report requires no account registration and is tied to a single transaction. Subscription Plans require an account (email/password or Google sign-in) so you can manage billing, view report history, and access the dashboard.

5. Payment

5.1 Price and currency

The price for a single, one-time Report is €9.99 (EUR, inclusive of applicable VAT). Subscription Plans (Monitor, Pro, Agency) are billed on a recurring basis (currently every 4 weeks) at the price shown on the pricing page at the time of purchase, inclusive of applicable VAT where required. The price displayed at checkout is the final price for that transaction.

5.2 Payment processing

Payments are processed by Lemon Squeezy, acting as Merchant of Record (see Section 6). By completing a purchase you also agree to Lemon Squeezy's terms of service and privacy policy. EcomVue does not store your full payment card details.

5.3 VAT

Where applicable, Belgian or EU VAT is included in the price. For B2B purchases within the EU, you may provide a valid VAT number at checkout to enable reverse-charge where applicable.

5.4 Recurring billing and cancellation

Subscription Plans renew automatically at the end of each billing period until cancelled. You can cancel at any time from your dashboard's billing page, which opens Lemon Squeezy's customer portal. Cancellation takes effect at the end of the current paid period — you keep access to Subscription features until that date, and no partial-period refund is issued except as described in Section 8.

6. Merchant of Record

Lemon Squeezy acts as the Merchant of Record (MoR) for all purchases made through ecomvue.ai, whether one-time Reports or Subscription Plans. In practice this means:

  • Your payment contract is with Lemon Squeezy, not directly with EcomVue. Lemon Squeezy is the seller of record for the transaction, and EcomVue is the provider of the underlying digital service (the Report and related features).
  • Lemon Squeezy calculates, collects, and remits applicable sales tax, VAT, and other transaction taxes on EcomVue's behalf in the jurisdictions where it is registered to do so.
  • Your card or bank statement will show a charge from "Lemon Squeezy" or a similar Lemon Squeezy billing descriptor, not "EcomVue".
  • Lemon Squeezy handles payment method security (PCI-DSS compliant), invoicing/receipts, and first-line billing support (failed payments, card updates, subscription portal access).
  • EcomVue remains solely responsible for the Service itself — generating, delivering, and supporting the content and quality of your Report and dashboard features.
  • Refund eligibility is determined under these Terms (Section 8); once a refund is approved, Lemon Squeezy processes the actual monetary transaction back to your payment method.

For billing-specific issues (statement questions, card/payment method issues, invoice or receipt copies) you may contact Lemon Squeezy support directly, or reach out to us at hello@ecomvue.ai and we will coordinate with Lemon Squeezy on your behalf. For questions about the Service itself (Report content, features, bugs), contact EcomVue directly.

7. Fulfillment policy

7.1 Nature of delivery

EcomVue delivers a purely digital service — no physical goods are shipped, and nothing is mailed to you.

One-time Reports

  • Generation begins automatically as soon as payment is confirmed.
  • Typically completes within a few minutes, depending on store complexity and third-party AI/web-search response times.
  • Once complete, the full Report is unlocked at its unique /report/[id] URL, with a link emailed to you if provided at checkout.

Subscription Plans

  • Dashboard access is granted immediately upon successful first payment.
  • Recurring re-audits run automatically on your plan's cadence.
  • You're notified by email when a new Report or score-change alert is available, per your notification preferences.

7.2 Delivery delays and failures

Because delivery depends on live AI analysis, web search, and third-party infrastructure, generation time can occasionally vary or, in rare cases, fail. If a Report you paid for does not generate or deliver within a reasonable time, contact hello@ecomvue.ai — see Section 8.2 for how failed deliveries are resolved.

7.3 Access period

A generated Report remains accessible via its unique link for as long as the underlying data is retained (see our Privacy Policy, Data Retention — currently 12 months from generation for one-time Reports). After that period the Report may be deleted and the link will no longer resolve. Subscription customers retain access to their report history for as long as their account/subscription data is retained.

7.4 No physical shipping

EcomVue never ships physical products. All deliverables (Reports, dashboard access, exported artifacts such as JSON-LD/robots.txt snippets) are delivered electronically only.

8. Right of withdrawal and refund policy

8.1 Consumer right of withdrawal — waiver

Under Belgian law (Wetboek Economisch Recht, Book VI) and EU Directive 2011/83/EU, consumers who purchase digital content have the right to withdraw from the contract within 14 days of purchase, without giving reasons.

By completing your purchase you expressly request that EcomVue begin generating your Report (or provisioning your Subscription Plan) immediately, and you acknowledge that you lose your right of withdrawal once this has started.

This waiver applies in accordance with Article VI.53, 13° of the Belgian Code of Economic Law (and the equivalent provision of Directive 2011/83/EU, Article 16(m)), which permits exclusion of the withdrawal right for digital content supplied with the consumer's prior express consent and acknowledgement that the right of withdrawal is thereby lost.

8.2 Refunds

One-time Reports: because each Report is generated on-demand using paid third-party AI credits, all sales are final and non-refundable once Report generation has started, except where required by applicable mandatory consumer protection law that cannot be excluded.

If you believe your Report was not delivered due to a technical error on our side, contact hello@ecomvue.ai within 7 days of purchase and we will investigate. In the event of confirmed non-delivery, we will either regenerate the Report or issue a full refund at our discretion.

Subscription Plans: the first billing period is subject to the same non-refundable rule above once your first Report/audit has been generated. For subsequent renewal charges, if you cancel before a renewal, you will not be charged again, but already-processed renewal charges are non-refundable, except for confirmed technical non-delivery (see above) or where required by mandatory consumer protection law. Cancelling does not retroactively refund the period already paid for; you keep access until the end of that period (see Section 5.4).

9. User obligations and acceptable use

By submitting a URL to EcomVue, you represent and warrant that:

  1. 1.You own or are duly authorised to submit that URL for analysis. Do not submit URLs belonging to third parties without their permission.
  2. 2.You will not use the Service for any unlawful purpose or in a way that violates any applicable law or regulation.
  3. 3.You will not attempt to reverse-engineer, scrape, or systematically extract data from the Service.
  4. 4.You will not submit URLs that contain or link to unlawful content (e.g. CSAM, malware, content that infringes third-party rights).
  5. 5.You will not misuse the Service to generate Reports for competitors without authorisation, for defamatory purposes, or in any way that harms third parties.

EcomVue reserves the right to refuse or cancel any order in its sole discretion if these conditions are not met.

10. Intellectual property

10.1 EcomVue IP

The Service, its design, interface, and underlying software are owned by or licensed to EcomVue. You may not reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.

10.2 Your Report

Upon full payment, EcomVue grants you a non-exclusive, non-transferable licence to use the Report for your own internal business purposes. You may not resell, sublicense, or publicly distribute the Report without our prior written consent.

10.3 Your content

You retain all rights to the URLs and any information you submit. By submitting a URL, you grant EcomVue a limited licence to process it solely for the purpose of generating your Report.

11. Disclaimer of warranties

To the fullest extent permitted by applicable law:

  1. 1.The Service, all Reports, and any dashboard features are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory.
  2. 2.EcomVue expressly disclaims all implied warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty arising from course of dealing or usage of trade.
  3. 3.EcomVue does not warrant that the Service will be uninterrupted, timely, secure, or error-free, that any Report will be accurate, complete, or achieve any particular result, or that any defects will be corrected.
  4. 4.No advice or information, whether oral or written, obtained from EcomVue or through the Service creates any warranty not expressly stated in these Terms.
  5. 5.Nothing in this section limits or excludes any warranty that cannot lawfully be excluded under Belgian or EU mandatory consumer protection law.

12. Limitation of liability

To the fullest extent permitted by applicable law:

  1. 1.EcomVue's total aggregate liability to you arising out of or in connection with these Terms or your use of the Service shall not exceed the total amount you paid to EcomVue in the 12 months preceding the claim (or, for a single one-time Report purchase, €9.99).
  2. 2.EcomVue shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of revenue, loss of data, loss of business or business opportunity, or reputational harm, even if advised of the possibility of such damages and even if a remedy fails of its essential purpose.
  3. 3.These limitations apply regardless of the legal theory of liability (contract, tort, negligence, strict liability, or otherwise).
  4. 4.Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded under Belgian or EU mandatory consumer protection law, including liability for gross negligence, wilful misconduct, fraud, or death/personal injury caused by negligence.

13. Third-party services

The Service relies on third-party providers including Anthropic (AI generation), Lemon Squeezy (payments and Merchant of Record), Supabase (database), Vercel (hosting), Upstash (rate limiting/security infrastructure), Resend (transactional email), and Klaviyo (marketing list and lifecycle event tracking). EcomVue is not responsible for the performance, availability, or data practices of these providers. Links or references to third-party services do not constitute endorsement.

14. Availability

EcomVue aims to keep the Service available but does not guarantee uninterrupted or error-free operation. We may suspend or discontinue the Service (or any Subscription Plan feature) at any time, with reasonable notice where practicable. If we discontinue a paid Subscription Plan feature you rely on, we will provide notice and, where appropriate, a pro-rated refund for the unused portion of your current billing period.

15. Changes to these terms

We may update these Terms from time to time. Material changes will be notified via a notice on the website at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

16. Governing law and jurisdiction

These Terms are governed by Belgian law, excluding its conflict-of-laws rules.

For consumers: nothing in these Terms affects your rights under mandatory Belgian or EU consumer protection law. If you are a consumer resident in another EU member state, you also retain the benefit of any mandatory provisions of the law of your country of residence.

For disputes with consumers, the competent courts are the courts of the consumer's domicile or the courts of the arrondissement where EcomVue's principal place of business is located. For disputes between businesses, the parties submit to the exclusive jurisdiction of the competent courts in Belgium.
